By registering on our site https://www.vivup.co.uk/ (“the Site”) you will have the ability to administer the Benefits Scheme you have signed up to with your Benefits Provider (“the Scheme”). This Site will allow you to order products and services applicable to your Scheme.

Registration

In order to use the Site and/or access certain sections on the Site, you will need to register on the Site.

By registering on the Site, you confirm that you accept these terms and that you agree to comply with them. If you do not agree to these terms, you must not register to use the Site.

Upon completion of the registration process and creating a username and password, you will be registered as a Registered User of the Site.

You warrant that:

  • The personal information which you are required to provide when you register is true, accurate, current and complete in all respects; and
  • You will notify us immediately of any changes to the personal information


You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

Upon completion of your registration details of your username and password will be emailed to you.

The authority to access the Site commences upon the relevant username and password being successfully created by you and ends if terminated in accordance with these terms or upon the expiration or termination of the applicable Scheme.

You are solely responsible for the security of your username and password and must not disclose your username and/or password to anyone.

You must inform Vivup immediately if your username and/or password have been compromised. In such a case, Vivup will reset your username and/or password for you.

All calls to Customer Services will be charged at the local rate (BT users only, other network charges may vary) and both inbound and outbound calls may be recorded for quality monitoring and training purposes.

These terms refer to the following additional terms, which also apply to your use of the Site:

  • Privacy Policy, which provides details about the personal data that will be collected from you and how this data will be processed.
  • Cookie Policy, which sets out information about the cookies on our site.


If you order any products or services via the Site, your applicable Scheme terms will apply to those orders. If you need a copy of your Scheme terms, please contact Vivup.

We amend these terms from time to time. Every time you wish to use the Site, please check these terms to ensure you understand the terms that apply at that time.

We may update and change the Site from time to time to reflect changes to the available products and/or services, our users’ needs and our business priorities.

We may suspend or withdraw the site

The Site is made available free of charge.

We do not guarantee that the Site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons. We are the owner or the licensee of all intellectual property rights in the Site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We have no control over the contents of those sites or resources.

Recommendations

When you use the Site, you will see that we offer you recommendations, showing products we think you might like and could perhaps miss when you are browsing the Site. These recommendations are based on your past order, top products, ratings and recently viewed products.

We determine your interests and suggest new products you may like. Additionally, we compare your interests and buying habits with the interests and habits of other customers, to show you relevant products.

Your recommendations may change when you make an order and move around the Site.

We take reasonable care to ensure our recommendations are in line with your behaviour as a Register User on vivup.co.uk.

Details of the products we recommend – such as price – are correct at the time of the recommendation is originally made to you but can be subject to change without notice.

Our responsibility for loss or damage suffered by you

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any products to you, which will be set out in the terms for the applicable Scheme.

How we may use your personal information

We will only use your personal information as set out in the Privacy Policy.

Which country’s laws apply to any disputes?

These terms, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
